Terms of Service

Please read these Terms of Service ('Terms') carefully before using airsource SaaS ('airsource', 'the Service') operated by ANKH Inc. ('we', 'us'). By accessing or using the Service, you agree to be bound by these Terms.

1. Private Beta Access

  • airsource is currently in private beta. Paid subscription plans (Starter $9/mo, Pro $29/mo, Business $99/mo) are available to invited waitlist users.
  • Access is granted on an invitation basis as we onboard waitlist users in order.
  • Subscription begins on the date of plan selection and is billed monthly in advance.

2. Subscriptions & Billing

  • Paid subscriptions are billed monthly in advance.
  • You may cancel your subscription at any time from the dashboard.
  • Cancellation takes effect at the end of the current billing period.
  • We do not offer pro-rated refunds for partial months.
  • If a payment fails, we will retry for 3 days before suspending your account.

3. Acceptable Use

  • You must not use the Service to send spam or unsolicited commercial communications.
  • You must not attempt to gain unauthorised access to other users' accounts or connected APIs.
  • You must not use third-party data obtained through the Service without the appropriate authorisations.
  • You must not reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Violation of these rules may result in immediate account termination without refund.

4. Service Level (SLA)

  • We target 99.0% monthly uptime, provided on a best-effort basis without financial SLA guarantees on Starter plans.
  • Scheduled maintenance windows will be communicated at least 24 hours in advance.
  • Sync failures due to third-party API downtime (Stripe, Airtable, etc.) are outside our SLA scope.

5. Intellectual Property

  • The Service, including its design, code, and content, is owned by ANKH Inc..
  • You retain all rights to your data (sales records, API credentials, destination records).
  • By using the Service, you grant us a limited, non-exclusive licence to process your data solely to provide the Service.

6. Disclaimer of Warranties

  • The Service is provided 'as is' and 'as available' without warranties of any kind.
  • We do not warrant that the Service will be uninterrupted, error-free, or fit for a particular purpose.
  • To the fullest extent permitted by law, we disclaim all implied warranties.

7. Limitation of Liability

  • To the maximum extent permitted by applicable law, our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 3 months preceding the claim.
  • We are not liable for any indirect, incidental, special, or consequential damages.

8. Termination

  • You may terminate your account at any time from the dashboard.
  • We may terminate or suspend your account immediately for violation of these Terms.
  • Upon termination, your right to use the Service ceases immediately. Data is deleted within 24 hours.

9. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Japan.
  • Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the Tokyo District Court.

10. Changes to These Terms

  • We may update these Terms at any time. For material changes, we will notify you by email at least 7 days before the changes take effect.
  • Continued use of the Service after changes constitute your acceptance of the new Terms.
